Welcome to the Ospheric Creations Limiteds website. By using this website and placing an order with us, you agree to be bound by the following Terms and Conditions. Please read them carefully before proceeding.
Definitions
“Seller” refers to Ospheric Creations Limiteds.
“Buyer” refers to the person whose name is specified on the Order.
“Contract” encompasses the order and Order Confirmation, inclusive of any Special Conditions.
“Goods” denotes the products or services to be sold by Ospheric Creations Limiteds in accordance with these Terms and Conditions.
“Order” signifies the Buyer’s request for Goods or services.
“Order Confirmation” denotes the Seller’s written confirmation as per Condition 3(b).
“Price” indicates the cost of Goods, inclusive of postage and packing, applicable at the time of the Order.
“Special Conditions” are specific terms related to orders outlined in the Order Confirmation.
“Terms and Conditions of Business” refers to the standard terms and conditions set forth in this document.
“Writing” includes communication via email with clear identification of sender and recipient, or displayed on a visual display unit.
Basis of Sale
These Terms and Conditions, along with any Special Conditions, govern the Contract to the exclusion of any other terms.
Any variations to these Terms and Conditions and Special Conditions are binding only if agreed upon in writing by authorised representatives of Ospheric Creations Limiteds and the Buyer.
Ospheric Creations Limiteds’ employees are not authorised to make representations regarding the Goods unless confirmed in writing. By entering into the Contract and accepting delivery, the Buyer acknowledges not relying on any representations about the Goods unless confirmed in writing.
Orders and Specifications
All Goods are subject to availability and the Seller’s acceptance of the Order.
The Seller reserves the right to reject any Order without obligation to provide reasons. An Order is deemed accepted only upon unconditional confirmation by the Seller in the Order Confirmation.
The Seller may update the specifications of Goods without prior notice due to continuous product development.
While efforts are made to accurately display and describe the printed colours of Goods on the website, exact colour matching cannot be guaranteed due to variations in colour systems.
Price and Payment
All prices exclude VAT. VAT will be added during checkout based on the final order value plus delivery costs.
Payment via credit card, debit card, or PayPal is required upon placing an accepted Order. The Contract becomes effective upon full payment. Failure to complete payment may result in ownership of supplied Orders reverting to the Seller.
Delivery
Goods will be delivered to the address specified in the Order.
The Seller aims to process and manufacture Goods within the stated timeframe on the Order Confirmation. Delivery dates are estimates, and delays do not entitle the Buyer to compensation.
The Buyer must inspect Goods upon delivery and sign the delivery document. Signing confirms receipt of the correct quantity of undamaged Goods. Any alleged damage or defects must be noted and signed for upon delivery.
Risk and Property
Risk of damage or loss of Goods passes to the Buyer upon delivery.
Property in Goods remains with the Seller until full payment of the Price and any other due sums.
Returns, Refunds, and Cancellation Rights
The Buyer may cancel an Order if Goods are not delivered within 28 days from the Order date.
For faulty Goods, the Buyer must notify the Seller promptly upon discovery, within 3 days of delivery, and return the Goods for assessment. The Seller may choose to replace or refund faulty Goods.
Goods made to the Buyer’s specifications cannot be cancelled except in cases of faulty or defective goods.
Upon cancellation under Condition 7(a), the Seller will refund all sums paid for the relevant Goods.
Limitation of Liability
The Seller is not liable for short delivery or faulty Goods unless notified as per Condition 7(a) or upon reasonable inspection.
The Seller is not liable for failure or delay in performance due to circumstances beyond its control.
The Seller’s liability for any claims related to the Contract is limited to the net purchase price of the Goods or services.
Intellectual Property
The content on the Ospheric Creations Limiteds website is copyrighted by the Seller. Unauthorized modification or use of website content violates Seller’s copyright.
Use of digitalprinting.co.uk trademarks and trade dress is prohibited without prior permission.

General
Notice, governing law and jurisdiction, waiver, statutory rights, severability, website availability, typographical errors, license, off-site links, headings, user registration, eligibility, account activity, user suspension, termination, right of removal of materials, indemnification, and amendments are covered under general and miscellaneous provisions.
